1. Terms of Service for MaintWiz

Welcome to MaintWiz! The following Terms of Service govern your access to and use of the MaintWiz Computerized Maintenance Management System (CMMS) software, whether as Software as a Service (SaaS) or through a perpetual licence. These terms form a legally binding agreement between you, the customer (referred to as “Client,” “Customer,” “You,” or “Subscriber”) and MaintWiz Technologies Private Limited (“MaintWiz,” “Company,” “Service Provider,” “We,” “Us,” “Our”).

By using our services, you agree to comply with the following terms, which include limitations, usage guidelines, and legal commitments. Please read them carefully before accessing or using our service.

1. Definitions

  • Client: The entity or person using the MaintWiz CMMS software.
  • Service: The MaintWiz CMMS, including all features and functionalities, as well as any upgrades, enhancements, and updates provided.
  • Subscription: The monthly, quarterly, or annual payment plan selected by the Customer for access to the MaintWiz CMMS.
  • Account: Your user account that gives access to the Service.

2. Access to the Service

MaintWiz provides a cloud-based CMMS solution aimed at improving maintenance operations, such as planning, scheduling, and reporting. The software is designed to support modern technologies, including the Internet of Things (IoT) and data analytics.

MaintWiz offers a fully integrated, scalable solution for managing your operations and maintenance tasks, without requiring a significant capital investment.

3. Eligibility for Use

To use MaintWiz:

  • You must be at least 18 years of age or the legal age required in your jurisdiction.
  • You must not have been previously banned or removed from our services.

By registering, you represent that the information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and are liable for all activities conducted under your account.

4. Subscription Fees and Billing

Your use of the MaintWiz service is subject to payment of a subscription fee, which is outlined in your Pricing Agreement. Subscription fees are non-refundable and payable in advance for the subscription period.

  • Billing: Subscription fees are billed monthly, quarterly, or annually as agreed.
  • Cancellation: You can cancel your subscription at any time, but no refunds will be issued for unused portions of the subscription.
  • Auto-Renewal: Your subscription will automatically renew unless cancelled before the renewal date.

5. Trial Versions

MaintWiz may offer a free trial of the service. During this trial, all features will be available unless specified otherwise. Once the trial period expires, your data and customizations will only be retained if you choose to purchase a paid subscription.

6. Permitted Use

You may use the MaintWiz software only for your internal business purposes:

  • Licence: MaintWiz grants you a non-exclusive, non-transferable right to access and use the software.
  • Restrictions: You are not allowed to resell, sublicense, copy, modify, or distribute any part of the Service unless expressly permitted by MaintWiz.

7. Customer Data

  • Ownership: All Customer Data entered into the software remains your property. MaintWiz will not access or share your data except as required by law or for necessary support and troubleshooting.
  • Security: MaintWiz employs industry-standard measures to protect your data. However, no security method is infallible, and MaintWiz cannot guarantee absolute protection.

8. Account Suspension and Termination

MaintWiz reserves the right to suspend or terminate your account if:

  • You engage in illegal activity.
  • You fail to make payments.
  • You breach any of the terms outlined in this document.

Upon termination, you will lose access to the Service, and any Customer Data will be permanently deleted unless otherwise agreed.

9.Modifications to the Service

MaintWiz may, at any time, modify the features of the service, provided reasonable notice is given to customers. Any changes in fees will apply only to future billing cycles.

10. Limitation of Liability

MaintWiz provides the service on an “as-is” basis and makes no warranties regarding its functionality or availability. The company will not be liable for any damages, data loss, or business interruptions arising from your use of the Service.

11.Intellectual Property

All intellectual property related to MaintWiz, including but not limited to trademarks, logos, software code, and documentation, is owned by MaintWiz. You may not use or reproduce any intellectual property without prior written consent.

12.Confidentiality

Any confidential information shared by MaintWiz or its customers must be protected from unauthorised use and disclosure. Both parties agree to maintain the confidentiality of each other’s information.

13. Force Majeure

MaintWiz shall not be held liable for delays or failure in performance due to causes beyond its reasonable control, including but not limited to natural disasters, strikes, or technical failures.

14. Governing Law

These Terms of Service are governed by the laws of India. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts in Chennai, India.
